These Terms of Service (“Terms”) govern your use of recube.com (the “Site”), including its commission calculator, savings reports, and agent-matching service (collectively, the “Services”). The Site and Services are operated by Nyree Sevan Kolanjian, a California-licensed real estate broker, DRE #01851579. In these Terms, “REcube,” “we,” “us,” and “our” refer to Nyree Sevan Kolanjian as the operator of the Site and Services. REcube is the name used for the Site and Services and is not a separate legal entity. By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Site or Services.
What REcube does
REcube provides an informational tool that estimates a fair listing-agent commission rate for a given property based on publicly available and licensed real estate data, market conditions, and the information you enter. Optionally, we can email you a savings report or connect you with an independent, licensed real estate agent.
Estimates are informational only
Estimates depend on the accuracy and completeness of the underlying data and the information you provide, both of which may contain errors or be out of date. We make no guarantee that any agent will accept a rate suggested by the Site.
No agency relationship
Using the Site, the calculator, or the savings report does not create an agency, brokerage, fiduciary, or client relationship between you and REcube. REcube does not represent you in any transaction. If we match you with an agent, that agent — not REcube — is responsible for any representation, and any agency relationship you form is directly between you and that agent under a separate agreement.
Agent matching and referral fees
REcube is operated under a California real estate broker license. If you request an agent match, we will refer you to an independent, licensed real estate agent. Agents matched through the Site are independent professionals; we do not supervise or control their work and are not responsible for their acts or omissions.
If you close a transaction with an agent we referred, that agent may pay REcube a referral fee. This fee is paid by the agent out of their commission, not by you, and does not increase the commission you pay. You are never obligated to work with an agent we refer, and you are free to negotiate any terms directly with any agent.
Your responsibilities
- Provide accurate information when using the calculator or submitting a request.
- Only submit contact information that belongs to you.
- Use the Site for personal, non-commercial purposes related to your own real estate decisions.
- Do not scrape, harvest, or bulk-download data from the Site; probe, disrupt, or overload our systems; or use the Site for any unlawful purpose.
Intellectual property
The Site and its content — including the REcube name and logo, the design of the Site, our scoring methodology, reports, and generated content — are owned by REcube or its licensors and are protected by applicable intellectual property laws. You may use the Site's output for your own personal purposes (for example, sharing your savings report with an agent), but you may not reproduce, republish, or commercially exploit the Site or its content without our written permission.
Third-party services and links
The Site uses third-party services (such as Google address autocomplete and analytics) and may link to third-party websites, including our affiliated site CashOnlyHomes.com. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their own terms.
Privacy
Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Disclaimer of warranties
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ESTIMATES WILL BE ACCURATE OR COMPLETE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECUBE AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES — INCLUDING ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON AN ESTIMATE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
Indemnification
You agree to indemnify and hold REcube harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any rights of a third party.
Changes and termination
We may modify the Site or these Terms at any time. When we update these Terms, we will revise the effective date above and post the updated Terms here. Your continued use of the Site after changes are posted constitutes acceptance. We may suspend or terminate access to the Site at our discretion, including for violations of these Terms.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue there.
